These Terms concern the Website. They do not replace an engagement agreement or establish the terms of legal representation.

2. General Information, Not Legal Advice

The Website provides general information about Barnwell Law and criminal defense matters, including Michigan and Florida law. Its articles, practice descriptions, court information, and other materials are for informational purposes only and are not legal advice for your particular situation.

Laws, court rules, and procedures change. Website content may not reflect the latest developments or apply to your circumstances. Do not act or refrain from acting based solely on Website content. Obtain advice from an attorney authorized to practice in the relevant jurisdiction.

3. No Attorney-Client Relationship Through Website Use

Viewing this Website, submitting a contact form, requesting a consultation, sending an email or text message, leaving a voicemail, or making an online payment does not, by itself, create an attorney-client relationship.

Barnwell Law must determine whether it can accept your matter, including reviewing potential conflicts of interest, and agree to represent you. Ordinarily, the scope of representation and fees will be documented in a separate written engagement agreement. Do not assume that we represent you or are taking action on your behalf unless we have confirmed that representation.

Nothing in these Terms overrides an attorney-client relationship established under applicable law or our duties to clients or prospective clients.

4. Contact Forms and Sensitive Information

For an initial inquiry, provide your contact information and a brief, general description of the assistance you need. Do not submit Social Security numbers, financial account information, detailed admissions, evidence, or other confidential or sensitive material through a general contact form, ordinary email, text message, or voicemail unless we have provided appropriate instructions.

The Website’s contact forms transmit information through non-encrypted email. Electronic communications may be intercepted, misdirected, delayed, or accessed by unauthorized persons. Submitting information does not automatically establish attorney-client privilege.

We handle inquiries in accordance with applicable law and our professional obligations. These Terms do not waive any confidentiality protections or duties that apply to information received from clients or prospective clients.

5. Deadlines and Urgent Matters

Do not rely on a Website submission to meet a court deadline, respond to a warrant, arrange an appearance, or obtain immediate assistance. Contacting us does not extend a deadline, excuse a court appearance, or establish that we have agreed to take action.

Although we welcome inquiries at any time, delivery and an immediate response are not guaranteed. If your matter is urgent, call our office and confirm directly whether we can assist you. If you have not received confirmation that we represent you, seek other counsel as necessary to protect your rights and meet your obligations.

Barnwell Law advertises criminal defense services in Michigan and Florida. Representation in any particular matter depends on the relevant attorney’s authorization to practice, any required court admission, conflicts review, and our agreement to accept the matter.

Fees, costs, payment arrangements, and the scope of legal services are governed by the applicable engagement agreement and law. General fee information on the Website does not constitute a binding quote for your matter.

The Website links to a third-party payment service, currently LawPay. Transactions through that service are also subject to the provider’s applicable terms and privacy practices. Use only an authorized payment method and follow the payment instructions we provide. Do not submit payment card or bank account details through a general contact form.

Making a payment does not, by itself, confirm acceptance of a new matter or expansion of an existing representation. These Terms do not determine whether a fee is earned or refundable and do not override applicable rules governing client funds.

9. Permitted Use and Intellectual Property

You may access the Website for lawful purposes and view or print reasonable portions of its content for personal, noncommercial use, retaining any copyright or attribution notices.

Website content is owned by Barnwell Law or its respective owners and is protected by applicable intellectual property laws. Except as permitted by law or with the relevant owner’s written permission, you may not reproduce, republish, sell, or commercially exploit Website content or use our name or branding to imply an affiliation or endorsement.

Subject to applicable mandatory law, Michigan law governs these Website Terms. These Terms do not displace Florida law or professional conduct rules when those rules apply to a matter or attorney conduct.

If these Terms conflict with an applicable engagement agreement concerning legal representation, the engagement agreement controls, subject to law and professional obligations. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
